Privacy Policy

What information we collect, how we use it, who we share it with, and the choices you have.

Aypex, Inc. (“Aypex,” “we,” “us,” or “our”) provides software and tools consisting of the Aypex website, the Aypex mobile application (“app”), the Aypex Hub (“Hub”), and related products and features (together, the “Services”). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.

By using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services.

Who this policy covers

This policy applies to all users of Aypex, including individuals who use the Aypex mobile app, individuals and organizations who use the Aypex Hub, any visitors to the Aypex website, and all who interact with Aypex products.

Where an individual or organization uses the Services with their clients, the individual or organization and Aypex each handle data as described below. The individual or organizational user is responsible for their own relationships with, and obligations to, their clients.

Information we collect

Account and contact information. Your name, email address, password, and any profile details you provide.

Language content. When you complete a reflection by speaking or typing, we save the text of your reflection. Speech is transcribed to text on your device; raw audio is never transmitted off your device, saved, or retained. The transcribed text is processed to produce Aypex features and outputs. If interacting with an Aypex voice agent, audio is processed by a third-party service provider (ElevenLabs) and is subject to their privacy policy and terms. Aypex does not retain your raw audio.

Derived data. From your language and other inputs, the Services generate derived data, including performance indicators (Energy, Clarity, State of Mind, State), underlying constructs, insights, and trajectory patterns.

Connected device and health-adjacent data. With your permission, the app reads data from Apple Health, Health Connect, or your specific wearable provider (such as heart-rate variability, sleep, activity, etc) to add physiological context to your signal. You can disconnect these at any time in your device settings.

Calendar data (Aypex Hub). With your permission, the Hub connects to your calendar (e.g., Google Calendar) to support session scheduling.

Subscription and billing data. Subscriptions are processed through Stripe, the Apple App Store, or Google Play. We do not collect or store full payment card numbers; our payment processors handle that information under their own terms.

Usage, device, and log data. Device type, app version, IP address, and interaction logs used to operate, secure, and improve the Services.

Website data. Standard web analytics and cookies (see the Cookies and Website Analytics section below).

Privacy boundaries

If you are working with a performance professional, they never see the raw content of your entries. Hub users see only derived signals, abstracted patterns, and trajectory for clients connected to them.

Raw reflection content is architecturally excluded from any coach-facing or organization-facing surface.

No organization receives individual-level visibility into a person who has not explicitly elected to share with them.

How we use your information

We use the information we collect to:

  • Provide, operate, and maintain the Services, including generating derived data;
  • Deliver signals and trajectory to a Hub user you have connected with;
  • Process subscriptions, billing, and account management;
  • Provide customer support and respond to your requests;
  • Secure the Services, prevent fraud and abuse, and enforce our terms;
  • Improve and develop the Services and our models, and create de-identified and aggregated data for research, analysis, model development, and publication of findings (de-identified and aggregated data does not identify you, is not your personal information, and is not subject to the rights described herein);
  • Send service-related communications and, where permitted, product updates; and
  • Comply with legal obligations.

We process this information based on your consent, our legitimate interests in operating and improving the Services, and our legal obligations, as applicable.

How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

We share information only in these circumstances:

  • Service providers (subprocessors). We use trusted vendors to run the Services, bound by agreements that restrict their use of your data to providing services to us. These include cloud and data infrastructure (Google Cloud Platform), AI functionality and processing (Google Cloud Platform), voice transcription (ElevenLabs), telephony (Twilio), and billing (Apple App Store, Google Play Store, Stripe).
  • Hub users. Client data is shared with Hub users you have connected with and never includes raw content of your reflections.
  • Legal and safety. When required by law, or to protect the rights, safety, or property of users, the public, or Aypex.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

Data retention

Reflection text, connected data, and derived data: retained for as long as your account exists, including periods when you do not have an active subscription. This allows you to return to the Services without losing your history. If you want this data deleted, delete your account.

Account and billing records: retained as needed to operate the Services and meet legal, tax, and accounting requirements.

When you delete your account, we delete or de-identify your personal information within a reasonable period, except where retention is required by law. De-identified and aggregated data, which no longer identifies you, may be retained and used as described in the How We Use Your Information section. You may opt out of future use of your data for research and model development by emailing support@aypex.ai. Note that data already de-identified, aggregated, or incorporated into trained models or published findings cannot be retrieved or deleted.

Your rights and choices

You can access and delete your data directly in the app. For anything else, corrections, restrictions, or other requests, email support@aypex.ai. We do not sell or share your personal information. We will respond within the timeframes required by applicable law and will never discriminate against you for exercising your privacy rights.

Sensitive information

Some information, including the language saved, signals derived, and any health-adjacent data may be considered sensitive. We process it only to provide the performance functions of the Services, with your consent, and within the privacy boundary described above.

Aypex is a performance instrument, not a healthcare product. Aypex is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It does not provide medical, psychological, or clinical care. If you are experiencing a crisis or believe you need medical or mental health support, contact a qualified professional or emergency services.

Cookies and website analytics

The Aypex website uses essential cookies to function and may use analytics cookies to understand site usage. Where required, we ask for your consent and default to the more privacy-protective option. You can control cookies through your browser settings.

Eligibility

The Services are intended for users 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us at support@aypex.ai, and we will delete it.

International users

If you access our Services from outside the United States, you consent to data processing in the U.S. and acknowledge that local laws may differ.

Security

We use technical and organizational measures, including encryption in transit and at rest, access controls, and the infrastructure-level privacy boundary described above to protect your information. No system is perfectly secure, but we work tirelessly to protect your data and to address issues promptly.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a new “Last Updated” date and, for material changes, provide additional notice where required.
